01About these terms
These Terms of Service (the Terms) govern your use of the Levercomm website and software (the Service), provided by the federal (Canada) corporation that operates in Québec under the registered business name Levercomm (Levercomm, we), of 1438 Rue Mackay, Unit 167, Montréal, Québec, Canada. By starting a trial, creating an account or using the Service, you agree to these Terms and to our Privacy Policy.
If you use the Service on behalf of a brokerage or firm, you confirm you are authorised to accept these Terms for it, and you means both you and that organisation.
02Levercomm is software only
Levercomm is software. It is not a lender, a mortgage broker or a mortgage brokerage, and it does not arrange, negotiate or provide mortgages or financing. Mortgage brokering in Canada is done by licensed brokers and brokerages, who remain responsible for their own licensing and compliance.
The Service helps brokers organise deals, analyse documents, rank lenders by fit and prepare and send packages. Levercomm does not act for borrowers or lenders, does not give financial, legal, tax, investment or lending advice, and is not a party to any mortgage or financing between your clients and lenders.
03Accounts and eligibility
The Service is intended for businesses, including licensed mortgage brokers and brokerages, property owners managing their own real estate and lenders. You must be at least the age of majority in your province and give accurate account information. You are responsible for keeping your sign-in credentials confidential and for all activity in your account.
Broker plans. Broker, Broker Pro, Team, Firm licence and Enterprise are for licensed mortgage brokers and agents only. Each broker on these plans must hold a valid mortgage licence (in Québec, a certificate from the AMF) in their province. Levercomm confirms licences in the background from your name and province (and brokerage, if given) against public registries, at signup and later; if we can't match it, we'll ask for your licence number in the app before your first lender outreach. Levercomm may verify your licence at any time. If no valid licence is found, Levercomm may limit the outreach features until it is resolved, or offer you a plan for property owners.
04Plans and subscriptions
The Service is offered on subscription plans described on our Pricing page, including Broker, Broker Pro, Team, Firm licence and Enterprise for brokers, plans for property owners, and a free plan for lenders. Features marked coming soon are not part of your subscription until released, and we do not promise a release date.
Prices are flat subscription prices. Where a plan is priced per broker, the price is based on the number of brokers on the plan.
05Free trial and automatic charge
Paid plans start with a 14-day free trial. You must provide a valid payment method to start the trial. Nothing is charged during the trial.
Your payment method is charged automatically when the trial ends unless you cancel before then. If you cancel before day 14 of the trial, you will not be charged.
06Minimum term, renewal and cancellation
After the trial, each paid plan has a 3-month minimum term. After the minimum term, your subscription renews monthly until you cancel. If you chose yearly billing, you pay for 12 months in advance at the yearly price (equal to 3 months free compared with monthly billing), and the subscription renews yearly until you cancel.
You can cancel from your account at any time. Cancellation takes effect at the end of the minimum term or the current billing period, whichever is later, and the Service stays available until then. Except where required by law, we do not refund fees already paid, including for partial billing periods.
The Service is intended for businesses. If a consumer protection law applies to you, such as Québec's Consumer Protection Act, nothing in these Terms limits the rights it gives you, and we will cancel and refund as that law requires.
07Prices, taxes and payment
Prices are in Canadian dollars and exclude applicable taxes (GST/HST, QST), which are added to your invoice. Payments are processed by our payment provider, Stripe; we do not store full card numbers.
We may change prices for future billing periods. We will tell you in advance, and a change will not apply before the end of your current minimum term or billing period.
08No fees tied to funded deals
Levercomm charges subscription fees only. We do not charge or receive any fee, commission or share tied to funded deals, and we do not accept payment from lenders for placement, priority or referrals. Property owners pay for tools, never for introductions.
09Your responsibilities as a broker
If you are a mortgage broker or brokerage, you remain solely responsible for:
- holding and maintaining the licences and registrations required in each province where you work (for example with FSRA in Ontario or the AMF in Québec);
- complying with the laws, regulations and professional rules that apply to your business, including disclosure, suitability, anti-money laundering and record-keeping obligations;
- obtaining your clients' consent before you upload, analyse or share their personal information, and sharing it only with lenders you are entitled to share it with;
- complying with Canada's Anti-Spam Legislation (CASL) when you send emails or campaigns through the Service, including having consent and identifying yourself as the sender;
- reviewing every package, figure and message before you send it.
10Acceptable use
You agree not to:
- upload information you have no right to use or share, or that is false or misleading;
- send unsolicited commercial emails or messages in breach of CASL;
- use the Service to misrepresent a borrower, a property or a lender's position;
- attempt to access accounts or data that are not yours, probe or disrupt the Service, or reverse engineer it except as allowed by law;
- resell or share the Service outside your plan, or use it to build a competing product;
- use the Service for any unlawful purpose.
We may suspend accounts that breach this section.
11The Levercomm Rating and analysis
The Levercomm Rating is an analytical score produced by software from the documents provided. It is not a credit rating, an appraisal, a lending decision or a promise that any lender will offer financing. Lenders make their own decisions.
Underwriting figures, loan sizing, lender fit scores and other outputs depend on the documents and data you provide and on automated analysis, which can contain errors. They are tools to support your own professional judgment, not a substitute for it.
12Lender information and matching
Lender lists, program information and fit rankings are provided for convenience and may be incomplete or out of date. Inclusion of a lender does not mean the lender endorses Levercomm or will review any file. MLI Select is a program of Canada Mortgage and Housing Corporation (CMHC); Levercomm is not affiliated with or endorsed by CMHC.
13Your content and Google Drive
You keep ownership of the documents, data and materials you upload or create (Your Content). You give Levercomm a limited licence to host, process and transmit Your Content only to provide and improve the Service for you, and as described in the Privacy Policy.
When you connect Google Drive, your files stay in your own Drive. Levercomm is not a document storage service: it reads your Drive files to provide the Service and does not keep copies of them. Documents your clients send through intake links and the packages Levercomm builds for you are saved to your Drive. You are responsible for keeping your own copies of your files.
14Third-party services
The Service relies on third-party services such as Google (Drive and sign-in), Stripe (payments) and our hosting and database providers. Their own terms apply to your use of them, and we are not responsible for their services.
15Changes to the Service
We improve the Service continuously and may add, change or remove features. If we remove a feature that is material to your paid plan, we will tell you in advance and you may cancel without waiting for the end of the minimum term.
16Disclaimers
To the extent permitted by law, the Service is provided as is and as available. We do not promise that the Service will be uninterrupted or error-free, or that any deal will be funded or any lender will respond.
17Limitation of liability
To the extent permitted by law, Levercomm is not liable for indirect, incidental, special or consequential damages, or for lost profits, lost fees, lost deals or lost data, arising from the Service. Our total liability for any claim relating to the Service is limited to the fees you paid to Levercomm in the 12 months before the event giving rise to the claim.
Nothing in these Terms limits liability that cannot be limited by law.
18Indemnity
You agree to indemnify Levercomm against claims by third parties arising from Your Content, your breach of these Terms or your breach of laws that apply to your business, including licensing, privacy and anti-spam laws.
19Suspension and termination
You may stop using the Service and cancel at any time as described above. We may suspend or end your access if you breach these Terms, if required by law or if your account is unpaid. On termination, we delete data processed by Levercomm as described in the Privacy Policy.
20Governing law
These Terms are governed by the laws of the Province of Québec and the federal laws of Canada that apply there. The courts of the judicial district of Montréal, Québec, have exclusive jurisdiction, unless a law that applies to you gives you the right to bring a claim elsewhere.
21Changes to these terms
We may update these Terms. We will give notice of material changes by email or in the Service before they take effect. If you do not agree, you may cancel before the change takes effect.
